The Olmstead Ruling and Supported Employment: APSE Issues Position Paper The Association for Persons in Supported Employment (APSE) has issued a series of far-reaching recommendations as part of a position paper on the US Supreme Court Olmstead decision. In a 1999 decision, Olmstead v. L.C. and E.W., the Supreme Court stated that the denial of community placements to individuals with disabilities and unnecessary segregation and institutionalization constitute discrimination. It is APSE's position that supported employment, defined as paid employment in integrated settings, with ongoing support, is consistent with the Olmstead ruling. Research: People with Mental Retardation More Likely to be Segregated in Employment
Recent research examined employment outcomes for adults with disabilities who have received vocational services in the US. The authors found that compared to other working-age persons with disabilities, adults with mental retardation, numbering approximately 278,000, have much lower rates of competitive employment, and are much more likely to be employed in segregated work settings.
